This SMS Privacy Policy explains how Kured Functional Health ("we","us",or"our") collects, uses, and protects information when you subscribe to our text messaging services.

This policy establishes guidelines for the appropriate and compliant use of SMS/text messaging between the clinic, its staff, and patients. The goal is to improve communication while maintaining confidentiality, professionalism, and compliance with HIPAA, California privacy laws, and clinic standards.

This policy applies to all clinic employees, contractors, and providers who use SMS/text messaging to communicate with patients, caregivers, or other healthcare professionals.

 

3. Data Collection

We collect your full name, phone number, email address and any other relevant information as necessary.

 

4. Acceptable Uses of SMS

Clinic staff may use SMS for non-sensitive, non-clinical communications, including: 

  • Appointment reminderes, confirmations, and notifications (new appointment, reschedule, cancellation, and surveys).
  • General wellness check-ins or preventive health reminders (e.g., follow-up visit, vaccine shot).
  • Clinic announcements (holiday closures, new services, health events).
  • General health information and practice updates as you requested.
  • Billing/payment reminders (without detaild PHI).

We use the information we collected to improve our services, patient communication, and to provide customer/patient support. We will not use it for any other purpose.

We take reasonable steps to protect your information. However, you acknowledge that text messaging is not a fully secure method of communication. By opting in, you accept this risk. We will not use text messages to communicate highly sensitive PHI unless you have provided specific, additional consent for such communication.

 

5. Prohibited Uses of SMS

Staff may not use SMS for:

  • Transmission of Protected Health Information (PHI), including diagnosis, test results, or treatment plans.
  • Emergency or urgent medical communication.
  • Precription details or refill approvals.
  • Mental health, substance use, or other sensitive clinical information.

 

6. Patient Consent

  • Patients must opt in before receiving SMS communications, documented in the medical record.
  • Patients may opt out at any time by replying "STOP" or notifying staff. We will process your request within 24 hours and discontinue sending messages.
  • Consent must be renewed if a patient changes phone numbers.

 

7. Data Retention

Your data is kept only as long as required by healthcare regulations. After this period, it is deleted unless otherwise mandated by law.

 

8. Data Sharing and Disclosure

  • Privacy Policy Disclaimer: "SMS opt-in or phone numbers for the purpose of SMS are not being shared with any third party and affiliate company for marketing purposes."
  • We will not sell, rent , or lease your mobile phone number or any other information to third parties. We may share your information with our SMS providers who assist us to operate our SMS service and to the secure delivery of messages. These providers are contractually obligated to protect your information and use it only for the purposes we specify and in compliance with HIPAA.
  • We may also disclose your information if required by law or to protect our rights, property, or safety, or the rights, property, or safety of others.

 

9. Security & Privacy

  • SMS messages will not contain sensitive PHI.
  • Clinic staff must only use clinic-approved platforms for bulk or automated SMS.
  • Personal mobile devices may not be used for patient SMS unless specifically authorized.
